Congress Averts Physician Pay Cut

July 22, 2008:
On July 9 Congress passed the Medicare Improvement for Patients and Providers Act of 2008, legislation that, among other things, not only prevents the 10.6 percent cut in physician payment that was supposed to take effect July 1, but replaces it with a 0.5 percent increase effective until December 31, 2008.

The bill, which passed with enough votes to prevent presidential veto, also allows for a 1.1 percent update in 2009. Since this bill address the payment update through December 2009, Congress has 18 months to develop a long-term solution.

The bill's other provisions also:
  • Provide for the gradual elimination of copayment rates for Medicare psychiatric services
  • Revise requirements for and extend the quality reporting system, including incentive payments
  • Direct the secretary of the Department of Health and Human Services to establish a physician feedback program
  • Provide for coverage of pulmonary and cardiac rehabilitation
  • Amend title XVIII (Medicare) of the Social Security Act to delay until after 2011 full implementation of the Medicare competitive acquisition program for the purchase of durable medical equipment(DME), prosthetics, orthotics, and supplies (DMEPOS)
  • Create the Medicare Improvement Fund
